1. Definitions
- User: any person who uses the Service, with or without an account.
- Account: a personal registered profile linked to login credentials.
- Guest mode: limited use of the Service without registration.
- Content: all information in the Service, including prices, map data, text, and notifications.
2. Scope
These Terms apply to all use of Pompje, including but not limited to: sign-in and registration, guest access, viewing fuel prices and stations, map and list views, filters and sorting, manual location and coordinates, favourites, price notifications, vehicle and license plate features, theme and language settings, submitting price corrections, navigation to external apps, and communication with our servers. Additional rules or notices in the app form part of these Terms unless explicitly stated otherwise.
3. Description of the Service
Pompje is an information service that helps find and compare fuel stations and prices in the Netherlands. The Service is advertisement-free. We aim to provide clear, up-to-date information but do not guarantee completeness, accuracy, or availability. The Service does not replace your own checks at the station.
4. Accounts, guest use, and authentication
You may use the Service as a registered user (email and password, and where available via third-party providers such as Google or Apple) or as a guest. An account is personal; you are responsible for keeping your credentials confidential and for all activity under your account. During registration you must accept these Terms; without acceptance you cannot create a registered account.
In guest mode, certain features are limited or disabled (including advanced filters, favourites, and price notifications). We may change guest access or account requirements at any time.
5. Age and authority
You represent that you are at least 16 years old, or the age at which you may lawfully give consent for processing of personal data in connection with the Service under applicable law. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation.
6. Rules of use
You use the Service only for lawful personal or business purposes and you will not:
- provide false or misleading information (including at registration, for license plates, or price reports);
- attempt to bypass, disrupt, or misuse the Service, servers, or security;
- scrape, copy, or redistribute substantial parts of the Service or data without our written consent;
- use the Service in any way that infringes third-party rights or applicable law.
We may restrict or terminate access (temporarily or permanently) for breach of these rules or where there is risk to the Service or other users.
7. Location, maps, and navigation
Some features use device location, manually entered places or coordinates, and map display based on open data. Where required, you grant permission through your device settings. Location and map data may be inaccurate; we are not responsible for routing or location errors.
Links to navigation apps (such as Google Maps or Waze) open external services outside our control. Use of those services is subject to their terms; they do not supply data to us for that navigation.
8. Fuel prices, notifications, and corrections
Prices and opening hours come from open data and other sources and may be delayed, incomplete, or incorrect. Always verify the current situation at the station before making a decision.
Registered users may save favourite stations and optionally receive notifications when prices change. Notifications depend on technical availability and data feeds; we do not guarantee timely or complete delivery.
Where the app allows, you may submit a price or data correction. You warrant that such reports are accurate to the best of your knowledge. We may review, ignore, or forward reports without obligation to update data.
9. Vehicle and license plate data
You may voluntarily link a license plate to show fuel filters and vehicle advice based on open RDW data. License plate and derived vehicle data are processed under these Terms. You are responsible for using only plates you are entitled to query.
10. Advertisement-free model and funding
Pompje is offered without in-app advertisements. To fund development, hosting, and operation and to keep the experience ad-free, we may analyse, process, and monetise data relating to you and your use of the Service, as further described in these Terms and insofar as permitted by law.
11. Personal data we process
Depending on your use, we may process including:
- account data (name, email, password hashes, preferred language, theme);
- authentication and session data (including tokens for external login);
- vehicle and license plate data you enter;
- favourites, notification preferences, and price notification history;
- fuel and filter preferences;
- location-related data (GPS, manual location, search radius);
- interactions with features (such as reports and app usage);
- technical data (device type, IP address, logs, error reports).
For registered accounts we store the time you accepted these Terms. Further detail on rights and contact may be set out in a separate privacy notice; where they conflict on privacy-specific matters, the privacy notice prevails.
12. Purposes, sharing, and commercialisation
We process data to provide and improve the Service, maintain security, provide support, and — where necessary — comply with legal obligations. By accepting these Terms you also agree that personal data and usage data may be shared with or provided to third parties (for example for analytics, marketing, profiling, and licensing to partners), insofar as permitted under the GDPR and other applicable law. This processing supports the advertisement-free nature of the Service.
13. Retention and security
We retain data no longer than necessary for the purposes for which it was collected, unless a longer period is required by law. We implement appropriate technical and organisational measures but cannot guarantee absolute security.
14. Open data and third-party services
The Service uses open data and open-source sources, including among others fuel price data (such as via ANWB Onderweg), map and location data (OpenStreetMap and related geocoding services), and license plate information (RDW Open Data). These sources have their own licences and limitations; we are not responsible for errors or changes in third-party source data.
15. Intellectual property
The Service, design, logos, software, and compiled content (except third-party material) are ours or our licensors'. You receive a limited, non-exclusive, non-transferable right to use the Service under these Terms. Nothing in these Terms grants rights to source code, databases, or commercial reuse without written consent.
16. Availability, changes, and maintenance
We aim for continuous availability but may suspend the Service in whole or in part for maintenance, updates, or security or legal reasons. Features may be added, changed, or removed. We are not liable for loss due to unavailability except where mandatory law provides otherwise.
17. Liability
To the extent permitted by law, our liability is limited to direct damage resulting from an attributable failure to perform the agreement, capped at the amount you paid us in the twelve months before the damage (if any), or — if no payments apply — €100, unless mandatory law sets a different limit.
We are not liable for indirect damage, consequential loss, lost profits, missed savings, or damage from incorrect prices, opening hours, locations, vehicle advice, notifications, or acts of third parties. Nothing in these Terms limits liability that cannot be excluded under mandatory law.
18. Termination
You may stop using the Service and — where applicable — request deletion of your account through channels in the app or by contacting us. We may terminate your account or access for breach of these Terms or if we discontinue the Service. After termination, certain data may still be retained as described under retention and legal obligations.
19. Your privacy rights
Under the GDPR you may — where applicable — have rights of access, rectification, erasure, restriction, objection, and data portability, and the right to lodge a complaint with a supervisory authority. Contact us to exercise these rights. Withdrawal of consent or objection to processing may mean that (parts of) the Service are no longer available, especially registered features that depend on the processing you challenge.
20. Governing law and disputes
These Terms and use of the Service are governed by the laws of the Netherlands. Disputes shall be submitted to the competent courts in the Netherlands, unless mandatory law designates another forum.
21. Changes to these Terms
We may amend these Terms. For material changes we will inform you where reasonably possible (for example via the app, email, or this website). The date at the top of this page indicates the latest version. Continued use after changes take effect constitutes acceptance, unless the law requires otherwise.
